Please read these Terms and Conditions (“Terms”) carefully before using our website.

1. Acceptance of Terms

These Terms govern your access to and use of rockinglucas.com (the “Site”), including browsing, creating an account, and purchasing products.

You may use the Site only if you agree to these Terms, our Privacy Policy, our California Privacy Rights page (if you are a California resident), and any other policies posted on the Site, all of which are incorporated by reference. By accessing or using the Site, creating an account, or placing an order, you confirm that you have read and agree to be bound by them. If you do not agree, you must not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order or create an account. If you are younger, you may use the Site only with the involvement and consent of a parent or legal guardian. You confirm that the information you give us is accurate and complete.

3. Changes to These Terms

We may change, add, or remove any part of these Terms, our Privacy Policy, and our other policies at any time and at our sole discretion. Changes take effect when we post the updated version on the Site, and the “Last updated” date will change. For material changes, we may also notify you by email or a notice on the Site. Your continued use of the Site, or placing an order after changes are posted, means you accept the updated Terms. It is your responsibility to review this page regularly. Orders are governed by the Terms in effect when the order was placed.

4. Accounts

To buy from us you may create an account. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at contact@rockinglucas.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraud or abuse.

5. Products, Pricing, and Availability

We try to display products, colors, descriptions, and prices accurately, but errors can occur. We do not guarantee that product descriptions, images, or other content are complete, current, or error-free.
All prices are shown in U.S. dollars (USD) and may change at any time without notice. Prices do not include shipping, handling, or applicable taxes unless stated.
Products are offered while supplies last. We may limit quantities and may discontinue any product at any time.
If we discover a pricing or product error, we may correct it and cancel or refuse orders placed at the incorrect price, with a full refund if you have already paid.

6. Orders and Payment

Placing an order is an offer to buy. We may accept or decline it, in whole or part, for any reason, including product availability, errors, suspected fraud, or problems with your payment. An order confirmation email does not guarantee acceptance.
Payment options: we accept credit cards. Payments are processed by Stripe, our payment processor, which keeps your payment information secure. We never receive or store your credit card information.
By submitting payment, you authorize the charge for your order total (including shipping and taxes) and represent that you are authorized to use the payment method.
If a payment is declined, reversed, or disputed, we may cancel the order and suspend your account.

7. Shipping and Delivery

Shipping. See the item details on each product page for estimated arrival times. Estimated arrival times are estimates, not guarantees. You are responsible for providing a correct shipping address; we are not liable for delays or losses caused by incorrect or incomplete information.

Customs and import taxes. For deliveries within the United States, import duties and fees are included in the checkout price. Buyers outside the United States may need to pay import duties, taxes, and fees upon delivery. You can contact us at contact@rockinglucas.com to confirm how these fees will be paid for your order. We are not responsible for any customs-related delays.

8. Returns, Exchanges, and Cancellations

Returns and exchanges. See the item details on each product page for return and exchange eligibility. Buyers are responsible for return shipping costs. If an item is not returned in its original condition, the buyer is responsible for any loss in value.

Cancellations. We accept cancellations. To request a cancellation, contact us at contact@rockinglucas.com within 2 hours of purchase. Requests made after that time may not be accepted, because your order may already be in processing.

Nothing in these Terms limits any right you have under mandatory consumer protection law.

9. Acceptable Use

You agree not to:

Use the Site for any unlawful, fraudulent, or harmful purpose
Interfere with or disrupt the Site, its servers, or its security features (including Cloudflare captcha and other protections)
Use bots, scrapers, or automated tools to access the Site or place orders, except as we expressly allow
Attempt to gain unauthorized access to accounts, systems, or data
Upload or transmit malware or malicious code
Impersonate another person or provide false information
Buy products for the purpose of unauthorized resale where we have restricted it

10. Intellectual Property

The Site and its content, including text, graphics, logos, images, product designs, and software, are owned by or licensed to Rocking Lucas and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site for personal, non-commercial use. You may not copy, reproduce, modify, distribute, or create derivative works from the Site or its content without our prior written permission.

11. User Content and Communications

If you submit reviews, comments, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display it in connection with our business. You confirm you have the rights to submit it and that it is not unlawful, misleading, or infringing. We may remove any content at our discretion. By providing your email or phone number, you agree that we may contact you about your orders and account.

12. Third-Party Services and Links

The Site relies on third-party services (such as Stripe, Google Analytics, and Cloudflare) and may link to third-party websites. We do not control and are not responsible for third-party sites or services, and your use of them is at your own risk and subject to their terms.

13. Disclaimers and Limitation of Liability

THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.

TO THE FULLEST EXTENT PERMITTED BY LAW, ROCKING LUCAS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, or any loss of profits, data, or goodwill, arising from your use of the Site or products. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE ORDER GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law, including liability for fraud or willful misconduct.

14. Dispute Resolution

Before starting any formal legal proceeding, you agree to contact us at contact@rockinglucas.com with a written description of the dispute and your requested resolution, and to give us 30 days to try to resolve it informally. Most concerns can be resolved this way. Formal proceedings are governed by Section 17.

15. Indemnification

You agree to indemnify and hold harmless Rocking Lucas and its owners, officers, employees, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Site, or your violation of any law or third-party right.

16. Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason. Provisions that by their nature should survive termination (including Sections 10, 13, 14, 15, and 17) will survive.

17. Governing Law

These Terms, and any dispute arising out of or relating to them, the Site, or your purchases, are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to Section 14, you agree that any legal action will be brought in the state or federal courts located in San Bernardino County, California, and you consent to the jurisdiction of those courts.

18. General

Entire agreement: These Terms, with the policies incorporated in Section 1, are the entire agreement between you and us about the Site.
Severability: If any provision is held invalid or unenforceable, the rest remain in effect.
No waiver: Our failure to enforce any right is not a waiver of it.
Assignment: You may not assign your rights under these Terms without our consent. We may assign ours freely.
Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
Electronic communications: You consent to receive notices from us electronically, including by email or posting on the Site.

19. Notice to California Residents

Under California Civil Code Section 1789.3, California users of the Site are entitled to the following consumer rights notice: the Site is provided by Rocking Lucas, contact@rockinglucas.com. If you have a question or complaint regarding the Site, please contact us by email.
